CDA Abogados (hereinafter referred to as “CDA”) with registered office at Goldsmith 135 Polanco, Miguel Hidalgo
11550 Mexico City, Mexico, CP 11560, Mexico City, Mexico with phone number (+52) 55 8624 0689 is responsible for obtaining, using, disclosing, storing, accessing, managing, exploiting, transferring and disposing (hereinafter and collectively referred to as the “Treatment”) of any information that is provided concerning a natural person identified or identifiable (hereinafter referred to as the “Personal Data”). For the aforementioned and in order to guarantee privacy and the right to informational self-determination of people, CDA makes this privacy notice available to you (hereinafter called the “Privacy Notice”).
In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter referred to as the “Law”), its Regulations (hereinafter referred to as the “Regulations”) and other applicable legal provisions , CDA will be obliged to observe, at all times, the principles of legality, purpose, loyalty, consent, quality, proportionality, information and responsibility.
1. Consent.
This Privacy Notice must be consulted by the owner of the Personal Data (hereinafter referred to as the “Owner”) before providing any kind of Personal Data to CDA.
The mere fact that the Holder provides Personal Data to CDA, will imply: (i) the granting of their consent for their Treatment in the terms provided in this Privacy Notice; (ii) that you know the purpose of the Processing of your Personal Data; and (iii) that you know the procedure to exercise your ARCO Rights (as said term is defined below), as well as to limit the use and disclosure of your Personal Data.
In order to revoke their consent, the Holder must send their request to the email account: mdv@cdabogados.com.mx or by going directly to the CDA offices located at Goldsmith 135 Polanco, Miguel Hidalgo 11550 Mexico City, Mexico, CP 11560, Mexico City, Mexico. The same procedure will be applicable in the event that the Holder wishes to express his refusal for the Processing of his Personal Data in relation to the purposes that are not necessary for the legal relationship with CDA.
2. Personal Data.
to. Purpose of the Processing of Personal Data.
The Personal Data will be used for the following main purposes, necessary to maintain the legal relationship between CDA and the Holder:
- Identification and contact;
- Presentation of service proposals;
- Provision of professional services in legal matters;
- Billing for professional services rendered;
- Control access and maintain security in the facilities;
- Compliance with legal obligations before authorities of various kinds.
As secondary purposes, CDA uses Personal Data to:
- Promote the various professional services it provides;
- Report on the publications in which you collaborate;
- Make invitations to events organized by CDA or in which you participate.
Our informational email campaigns contain tracking pixels that allow us to measure campaign effectiveness and provide you with more relevant emails based on your interests. In case you do not want your Personal Data to be processed in the informational campaigns, we offer you the option to “Unsubscribe” in the link provided at the end of any of the informational emails you receive.
Likewise, you can express your refusal to process your personal data for any of the secondary purposes by sending an email mdv@cdabogados.com.mx. The refusal in this sense will not affect in any way the legal relationship established between the Holder and CDA. The Holder will have a period of 5 days to express his refusal to process his Personal Data with respect to secondary purposes, remaining safe, in any case, the rights of the Holder to exercise his ARCO Rights.
CDA informs the Holders that, when the Personal Data is no longer necessary for the fulfillment of the aforementioned purposes or for the fulfillment of the legal obligations under its charge, CDA will proceed with the cancellation of the same.
In the event that CDA wishes to modify or extend the aforementioned purposes, it undertakes to modify this Privacy Notice and make it available to the Holders through its website.
b. Personal Data that will be processed by CDA.
CDA treats the following Personal Data: (i) Identification data: name, address, nationality, place and date of birth, marital status, RFC, CURP, autograph signature, age, gender, image; (ii) Contact information: address, cell phone, home phone, email; (iii) Employment data: Place where you work, Position or position held, work address, institutional telephone, institutional email; (iv) Migratory data: migratory quality; (v) Patrimonial and / or financial data: tax information, income or debts derived from a certain legal act; (v) Legal data: those related to the reason for the provision of legal services and (vi) Digital information: that related to the use you make of our website and access to our content or publications.
Since the Personal Data are provided directly by the Owner, it will be presumed that they comply with the quality principle until the latter manifests and proves otherwise, or until CDA has objective evidence in this regard.
We inform you that our website uses its own and third-party cookies, which allow us to improve the performance and scope of our services. To learn more about it, we put at your disposal our “Cookies Policy” which you can access in the corresponding section located on our website.
c. Transfer of Personal Data by CDA.
CDA declares that the Personal Data to which it has access may be transferred to third party service providers and suppliers with whom it has a legal relationship in order to comply with the purposes set forth in this Privacy Notice.
In the event that the Holder does not want their Personal Data to be transferred, they may express their refusal by sending an email mdv@cdabogados.com.mx.
Likewise, the Personal Data may be transferred without your consent being legally required, to the authorities in order to comply with the applicable regulations, for the safeguarding of a public interest or for the administration of justice, or when required for recognition, exercise or defense of a right in any judicial process or in the event that any assumption provided for in article 37 of the Law is updated.
3. ARCO rights, use and disclosure.
The Holder will have the rights indicated below (hereinafter referred to as the “ARCO Rights”):
(i) Right to know what Personal Data has the Owner’s CDA (Access);
(ii) Right to request the rectification of your Personal Data when these are outdated, inaccurate or incomplete (Rectification);
(iii) Right to have your Personal Data deleted from CDA’s records or databases (Cancellation).
(iv) Right to object, for legitimate reasons, to the Processing of your Personal Data (Opposition). If such opposition is appropriate, CDA will not be able to process the Personal Data relating to the Holder.
For the exercise of any of the ARCO Rights, the Holder must submit the respective request to the Personal Data Area of CDA, which will process the requests for the exercise of these rights, and will answer any questions you may have regarding the Treatment of your Personal information.
Additionally, the Holder will have the right to limit the use and disclosure of their Personal Data, as well as revoke the consent for the treatment thereof by means of a request addressed to the Personal Data Area of CDA.

If the Holder considers that his right to the protection of his Personal Data has been injured by any conduct or omission on the part of CDA, or presumes any violation of the provisions provided for in the Law, the Regulations and other applicable regulations, he may file his disagreement or complaint to the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI). 4. Modifications to the Privacy Notice.
This Privacy Notice may undergo modifications, changes or updates derived from new legal requirements; CDA’s own needs; of its privacy practices; changes in their business models or for other reasons.
Any kind of modification to this Privacy Notice will be communicated to the Holders by making the Privacy Notice available at www.cdabogados.com.mx
